Egg donation agreements are near and dear to our hearts. Egg Donation Agreements

A legal agreement between the parties is needed when entering into an egg donor arrangement.  This agreement will clarify the essential understandings of the parties, including the understanding that the recipients will have all parental rights to any child resulting from the donation, and the donor will not have any financial responsibilities or obligations to any child resulting from the obligation. The egg donation agreement may also address:

  • medical protocol, timing, and logistics of the retrieval procedure-restrictions, limitations, expectations of the donor

  • medical complications, including a possible back-up medical insurance policy

  • disposition of any remaining cryopreserved eggs and/or embryos formed from the donated eggs

  • confidentiality and disclosures

  • understanding as to future communication, both with parties and as to children

  • reimbursement for expenses and compensation

The firm is not able to represent both the egg donation recipient(s) and the egg donor in the same egg donation agreement. Independent counsel for all parties is an important element of the arrangement.
